====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-01-2022 Heard Mr. Sheo Kumar Prasad, learned Advocate for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners seek bail in anticipation of their arrest in connection with Kawakole P. S. Case No. 145 of 2020 instituted for the offences under Sections 341, 323, 307 and 447/34 of the Indian Penal Code.

Though the petitioners are also said to have assaulted the members of the prosecution party, but the accusation against them is general and omnibus. Persons who have received injuries in the occurrence namely Manoj Chaudhary, Pinki Devi and Upendra Chaudhary have received only simple injuries.

No.20642 of 2021(2) dt.11-01-2022 2/2 The occurrence took place on 12.05.2020, but the report regarding the same has been lodged on 16.05.2020 i.e. after a delay of four days and that also without any explanation. It has further been submitted on behalf of the petitioners that the dispute arose because of carving out the pathway. Considering the afore-noted facts and submissions advanced on behalf of the petitioners and taking into account the clean antecedent of the petitioners, they are directed to be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Nawada in connection with Kawakole P. S. Case No. 145 of 2020, subject to the condition as laid down under Section 438 (2) Cr. P.C.

The application stands allowed.
