Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

The FIR of the occurrence of dacoity was registered against unknown.

Submission is that the petitioner is in custody since 27.04.2018. He was never put on T.I. Parade during investigation nor any incriminating article was recovered from his possession. Only material is confessional statement of the co-accused before the police while in police custody. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court CR. MISC. No.10810 of 2019(3) dt.02-05-2019 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madhepur Police Station Case No.101 of 2017 giving rise to ST No.361 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
