ANJANA MISHRA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner, learned counsel for the State as well as the counsel for the Informant. The petitioner is apprehending his arrest in connection with Maner P.S. Case No. 467 of 2015 pending in the Court of Judicial Magistrate, Ist Class, Danapur, Patna for the offences instituted under Sections 302 and 120(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is no eye witness to the alleged occurrence and only because of property dispute, petitioner has been implicated in this case. Learned counsel appearing on behalf of the informant submits that the father of the informant had been murdered by Lav Kush Kumar and Vikash Kumar who were the sons of Santosh

Learned counsel for the State after going through the several paragraphs of the case diary submits that independent witnesses of the villagers have also supported the allegation. Considering the aforesaid facts and circumstances of the case, I am not inclined to release the above named petitioner on anticipatory bail, the same is rejected.
However, if the petitioner surrenders in the court below within a period of four weeks, the same shall be considered on its own merit without being prejudiced by this order. (Anjana Mishra, J) B.Kr./- U T
