13-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 06.02.2017 in connection with Main P.S. Case No. 13 of 2015 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 427, 435, 504 and 506 of the Indian Penal Code and 17 of the Criminal Law Amendment Act.

The prosecution case is that 10 to 12 unknown persons came and demanded levy from the contractor and on nonpayment they set the machine on fire. It has been submitted by the learned counsel for the petitioner that petitioner is innocent and not named in the First Information Report and it is only on the basis of confessional statement of co-accused that his name surfaced.

Patna High Court Cr.Misc. No.15476 of 2017 (2) dt.13-04-2017 Learned counsel for the petitioner further submits that there is no criminal history behind him, except confession, there is no other material against the petitioner. He also submits that other accused persons have since been granted the privilege of bail by coordinate Bench of this Court in Cr. Misc. No. 45077/2015 on 29.09.2015 and Cr. Misc. No. 51020/2015 on 05.02.2016.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - VI, Gaya, in connection with Main P.S.
