The petitioner seeks bail in Baruraj P. S. Case No. 14/16 instituted for the offence under Section(s) 399,402,414 of the Indian Penal Code and Section 25(1-b)a, 26(ii) and 35 of the Arms Act and Section 20/22 of the NDPS Act. In the written report, it is alleged that two persons, namely, Vijay Sahani and Shyam Kumar Yadav, were apprehended by the police who disclosed the name of this petitioner and other accused persons.

From the written report, it is apparent that there is no recovery of any incriminating article from possession of this petitioner. The name of this petitioner has been incorporated in the FIR on the basis of disclosure made by co- accused Vijay

Patna High Court Cr.Misc. No.9386 of 2019(2) dt.18-02-2019 2/2 Sahani and Shyam Kumar Yadav.

Learned counsel for petitioner submits that other co -accused with similar allegation has already been granted bail by co-ordinate Bench of this Court by order dated 24.1.2017 passed in Cr. Misc. no. 51560 of 2016.

The petitioner is in custody since 14/9/2018. Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Muzaffarpur, in connection with Baruraj P. S. Case No. 14/16 subject to the condition that both the bailors shall be the close relative of the petitioner.
