The petitioner, already in custody, seeks bail in connection with Hajipur Town P.S.Case No. 475 of 2016 registered under Sections 399, 402, 414, 467, 420, 472 of the Indian penal Code, Sections 25(1-B) (a), 26II and 35 of the Arms Act and Sections 20 and 22 of the Narcotic Drugs and Psychotropic Substance Act.

Allegation in brief is that the police apprehended 08 persons in the fish market and recovered Ganja and pistols from their possessions. The specific allegation against this petitioner is that one loaded auto pistol was recovered from his possession. Submission is that Ganja was not recovered from the possession of this petitioner and the same was in possession of the

Patna High Court Cr.Misc. No.15389 of 2017 (2) dt.29-03-2017 2/2 other accused persons.

Having considered the aforesaid facts and circumstances of the case and the recovery of loaded auto pistol and as the prayer for bail of another co-accused namely Vikram Kumar, whose case also stands on similar footing, has been rejected by a co-ordinate Bench of this Court by order dated 21.02.2017 in Cr. Misc. No. 4304 of 2017, so the prayer for bail of this petitioner is rejected.
