JUSTICE SATYAVRAT VERMA ORAL ORDER 11-03-2022 Heard learned counsel for the petitioners and Mr. Anant Kumar 1, learned A.P.P. for the State. The petitioners seek bail in connection with Sabour (Goradih) P.S. Case No. 273 of 2021 instituted for the offences under Sections 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2016..

Learned counsel for the petitioners submits that the petitioners are in custody since 28.10.2021, are persons of clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 81.7 liters of liquor from a vehicle. Learned counsel for the petitioners submits that the petitioners are Khalasi and Driver of the vehicle and as such,

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioners are in custody since 28.10.2021, charge-sheet has been submitted in the case and are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Special Judge Exclusive Excise Court No. 2, Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 273 of 2021.
