The petitioner is languishing in custody in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

It a case of commission of robbery in Bharat Finances Inclusion Limited by four unknown accused persons.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named

Patna High Court CR. MISC. No.10962 of 2023(3) dt.26-06-2023 2/2 in the F.I.R. Nothing incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has still not been put on T.I.P and only on the basis of co-accused Om Prakash and Shrikant @ Mukhiya, the name of the petitioner sprang up in the present case. The petitioner is languishing in custody since 01.11.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Bikramganj P.S. Case No. 235 of 2022.
