The petitioner has filed the instant application for grant of regular bail in connection with Nowkothi P.S. Case No. 134 of 2021 registered under sections 341, 504, 506, 307, 379 and 34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the co-accused persons including this petitioner is that they committed theft in the grocery store of the informant due to which she suffered a loss of Rs. 2,00,000/-. It is further alleged that they made firing but did not hit anyone and also they gave criminal intimidation to the informant as well as abused her.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.11824 of 2023(2) dt.24-04-2023 2/2 petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to long existing land dispute. It is further submitted that nothing specific allegation has been levelled against the petitioner. It is also submitted that no any consistent material came against him rather he has been dragged in this case on the basis of his previous criminal history. Moreover, he is languishing in judicial custody since 28.07.2022. The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Nowkothi P.S. Case No. 134 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Begusarai.
