The petitioner is apprehending his arrest in a case registered under Sections 420, 422, 423 and 120(B) of the Indian Penal Code.

The prosecution case in short is that the accused persons collected a sum of Rs. 28 lacs and thereafter misappropriated the same and fled away.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the

Patna High Court CR. MISC. No.13655 of 2020(6) dt.30-06-2021 2/3 present case. As per the allegation, the petitioner is one of the officers of the Non-banking Financial Company. The petitioner claims himself an agent of the said company. It is alleged that he deposited the money with the company. Subsequently, the Company did not return money to the investors. Notices were issued to O.P. No. 2 but none appears on behalf of O.P. No. 2. It has been submitted on behalf of the petitioner that there is no document on record to show that any money was given/deposited by the complainant to the petitioner. At best, it is a case of civil dispute between the parties. On behalf of the State, it is submitted that the petitioner is named in the F.I.R./complaint case.

Considering the aforesaid facts and circumstances and also the lockdown, the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on his personal bond to the satisfaction of Judicial Magistrate, 1st Class, Jamui in connection with Case No. 162(C)/2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with
