The petitioner seeks bail in Kazimohammadpur P.S. Case No. 66 of 2017 registered under Sections 409, 420, 467, 468 and 471 of the Indian Penal Code and Sections 3, 4 and 5 of Price Cheating and Money Circulating Scheme Act, 1978. The informant alleged that the business premises, namely, Amulya Sanchaya Producer Company Limited of the petitioner was searched and from perusal of the seized documents available in the office, legitimacy of this company was found to be suspicious.

Leanred counsel for the petitioner submits that

Patna High Court Cr.Misc. No.19189 of 2017 (2) dt.28-04-2017 2/2 there is no allegation of defalcation of funds. Similarly situated co-accused Ashok Kumar Choudhary has already been granted bail vide an order passed in Cr. Misc. No. 16378 of 2017 by a coordinate bench of this court. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-cum-Sub Judg, 1st, Muzaffarpur in connection with Kazimohammadpur P.S.
