JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

There is allegation against the petitioner and other FIR named accused persons that they having entered into the house of the deceased cut his neck as a result of which he died. The postmortem report goes to show that only one injury was found on the neck of the deceased. Moreover, having more or less similar allegation, co-accused Brij Kishore Rai, Jai Narayan Rai, Jang Bahadur Rai, Ranjeet Rai and Rajesh Rai have already been granted privilege of bail by different Benches of this Court.

Case No. 43 of 2018.
