Petitioner is accused in connection with Special Case No. 12 of 2015 arising out of Kursankanta (Sonamani Gudam) P.S. Case No. 118 of 2015 registered under Sections 21, 22 and 23 N.D.P.S. Act.

The accusation is that petitioner was carrying a bag at his head and on seeing the informant, A.S.I., S.S.B. threw the bag and started to flee away but the petitioner was caught hold and on search, 12 packets of Ganja, each containing 1 kg., were recovered from the bag.

Submission of learned counsel for the petitioner is that the petitioner was not apprehended by the informant and his

No.57290 of 2015 (5) dt.03-03-2016 2/2 associates with bags, rather the petitioner was apprehended from his house mere on suspicion and nothing has been recovered from his conscious possession. Further, it is submitted that he has no criminal antecedent and is in custody since 11.09.2015. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Araria in connection with Special Case No. 12 of 2015 arising out Kursankanta (Sonamani Gudam) P.S. Case No. 118 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
