JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-05-2022 Heard Mr. Rajesh Kumar Singh, learned Advocate for the petitioners and Mr. Akbar Ali, learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Marhoura P.S. Case No. 235 of 2020 dated 28.03.2020 instituted for the offences under Sections 147, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. The petitioner no. 1 is said to have assaulted one of the victims, who has but received only simple injury. There is a counter version of the occurrence also. It appears that there is a dispute between the parties and because of that, a scuffle took
Patna High Court CR. MISC. No.20485 of 2021(2) dt.13-05-2022 2/2 place in which both sides were injured and allegations have been hurled from both sides which appears to be highly exaggerated.
Regard being had to the aforestated facts, the petitioners are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chhapra in connection with Marhoura P.S. Case No. 235 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
