Petitioners seek bail in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

The FIR of the occurrence of murder is against unknown. During investigation, co-accused Babita Devi confessed the involvement of petitioner no. 1 as well as alleged that since the deceased had developed illicit relationship with one of the petitioners, he was done to death. Submission is that the allegation is false one. Petitioners are in custody since 01.09.2018 and 29.11.2018 respectively. They are husband and wife.

No.9823 of 2019(3) dt.30-04-2019 2/2 Considering the fact that there is no direct evidence against the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Barauni Police Station Case No. 92 of 2018, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
