JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by the learned counsel for the informant.

The petitioner seeks bail in Buxar Mahila P.S. Case No.13/16 for the offences under Sections 341, 323, 504, 506, 307, 498(A), 494/34 of I.P.C. and 3⁄4 of Dowry Prohibition Act. The accusation of the informant is of torturing her mentally and physically by her husband and his relatives and arranging second marriage with another lady.

It has been submitted on behalf of the petitioner that petitioner is ready to pay Rs.1.50 lacs in three installments within three months for treatment of O.P.No.2 and, as full and final settlement.

Patna High Court Cr.Misc. No.19553 of 2017 (4) dt.18-05-2017 Heard the learned A.P.P. and the learned counsel for O.P. no.2. O.P.No.2 has no objection.

In view of the submissions, made above, let the petitioner file a petition of such prayer and on placing such a petition in the court below and on payment of 1st installment of Rs.50,000/- within a period of one month and once the same is deposited in the court below, court below shall release him on provisional bail to his own satisfaction and thereafter petitioner will deposit Rs.1/-lakh in two equal installments within two months. On being satisfied with deposit of whole amount of Rs.1,50,000/- the court below shall confirm the bail bond, otherwise he is free to pass any other order or orders, as he may deem fit and proper.

It is also made clear that as both the parties have settled their dispute in terms as stated above, the learned court below will take appropriate step for expediting the trial and conclude the same preferably within a period of six months.
