Petitioner is an accused in connection with Bihta P.S. Case No. 1038 of 2019 for the offence registered under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in connection with the present case. It is further submitted that the petitioner is not named in the first information report. It is further submitted the name of the petitioner has surfaced on the basis of the confessional statement made before the police. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 25.11.2019.
