The petitioner seeks bail in a case registered under Sections 420, 409, 467, 468, 471, 472, 120(B)/34 of the I.P.C. Allegation is that the accused persons committed forgery and cheating of government money.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. Land acquisition was made. In respect of the same, award was prepared in the name of Sukhdeo Sah and the compensation

Patna High Court CR. MISC. No.9660 of 2019(3) dt.16-04-2019 2/2 amount to the tune of Rs.3,05,00,000/- was transferred, but later on it was found that the said amount was transferred in a fake account. The petitioner had no role to play in respect of transfer of the compensation amount. The petitioner had only certified that the land in question under acquisition belongs to one Sukhdeo Sah as per the revenue records.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Town Motihari P.S. case No.824 of 2018.
