JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 12-09-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Rail Mokama P.S. Case No. 49 of 2021, registered for the offences punishable under Sections 379 of the Indian Penal Code. As per allegation, when the infromant Aishwarya Sharma was traveling by train her purse including mobile set was stolen away.

Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and his name has figured on the basis of CDR/CIF.

On the other hand, learned Addl.P.P. has opposed the

Patna High Court CR. MISC. No.9867 of 2022(2) dt.12-09-2022 2/2 prayer for bail.

It has been found that the petitioner was using that stolen mobile set. As such, the petitioner does not deserve the privilege of anticipatory bail. Accordingly, it is rejected. The petitioner is directed to surrender before the court below and make a prayer for regular bail. The learned court below shall dispose of the same without being prejudiced by this order. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
