The petitioner is in custody in connection with Ahiyapur P.S. Case No. 917 of 2015 for offence punishable under Sections 20, 22 and 23 of the Narcotic Drugs and Psychotropic Substances Act. It is upon recovery of the narcotics in question described in the seizure list from the house of the accused Md. Munna that the petitioner along with others were arrested and sent to custody. Learned counsel for the petitioner submits that whereas it is specifically mentioned in the FIR that the recovery of alleged smack and ganja was made from the house of accused Md. Munna @ Rummi, it is only because the petitioner along with other named accused were present in his house that they also have been roped in the transaction without any recovery from their possession. Learned counsel submits that in similar circumstances bail has been granted to some of the co-accused in Criminal Misc. No. 54563 of 2015, Criminal

Having heard learned counsel for the parties and considering the nature of allegation as well as the circumstances existing, let the petitioner Rajeev Singh be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No. 917 of 2015.
