JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 Heard learned counsel for the petitioner.

This is an application for bail in connection with Birupur P.S.Case No. 15 of 2016 registered for the offences punishable under Sections 147, 148, 149, 307, 323, 385, 387, 504 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the FIR and later on his name transpired during the course of investigation. It has been submitted on behalf of the petitioner that petitioner's name comes in this case only on the basis of suspicion during the course of investigation stating that he has fired in order to terrorize the workers and there is absolutely nothing against him and he is in custody since 15.1.2017 and co-accused has been granted bail by this Court in Cr.Misc.No. 43308 of 2016, vide order dated 15.12.2016 (Annexure-2).

No.17693 of 2017 (2) dt.17-04-2017 2/2 Having heard both sides and considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate/ successor court, Lakhisarai, in connection with Birupur P.S.Case No. 15 of 2016, G.R.No. 764 of 2016, subject to the conditions that :- (i) Both the bailors should be close relatives of the petitioner having sufficient immovable properties within the jurisdiction of the concerned Court. (ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of his bail.
