JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given one Fersa blow causing injury on the head of the informant Jai Prakash Sah and subsequently the informant was assaulted by co-accused Kundan Kumar by means of lathi. The injury report of the informant reveals that altogether five injuries were found on his person and out of the aforesaid five injuries , one injury was found as incised wound on middle of skull, which was simple in nature and caused by sharp cutting weapon. The rests injuries of the informant are said to have been caused by hard and blunt substance and out of the aforesaid injuries, one injury was found on left parietal region

Patna High Court Cr.Misc. No.492 of 2016 (2) dt.07-01-2016 2/2 which was found to be grievous in nature. According to the first information report itself, the author of grievous injury is coaccused Kundan Kumar. Moreover, the alleged occurrence is said to have taken place on account of land dispute. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, Raxaul at Motihari in connection with Ramgarhwa P.S.Case No. 71 of 2015.
