JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 120B, 302, 201 and 34 of the Indian Penal Code.
Heard learned counsel for the petitioners.
It has been submitted on behalf of the petitioners that they have been made accused in this case because of the fact that the deceased was taken by the petitioners to Bangalore and thereafter, he did not return to informant. However, only on the basis of suspicion petitioners have been made accused in the present case. Other co-accused having similar allegation has already been granted anticipatory bail by a Bench of this Court vide order dated 09.01.2017 passed in Cr. Misc. no. 50599 of
Patna High Court Cr.Misc. No.8166 of 2017 (2) dt.27-02-2017 2/2 2016.

Having heard both sides, in view of the fact that there is only suspicion against these petitioners, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned S.D.JM., West, Muzaffarpur, in connection with Saraiya P.S. Case no. 485 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
