Although petitioner is named in the first information report but it were co-accused Pankaj Sharma and Akhilesh Das @ Ghebna Das who are said to have fired on the deceased. So far as the petitioner is concerned, it is only stated that he was also present in the court-yard of the informant having armed with pistol.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Khagaria in Sessions trial no. 303/2015 arising out of Pasraha P.S. Case no. 91/2015.
