This application is for grant of bail in connection with Ekma P.S.Case No.172 of 2015 for the offence under Sections 304(B), 201 and 34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that no case is made out under Section 304(B) of the IPC and the deceased died due to diaohorrea. The petitioner is in custody since 05.01.2017. Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact that F.I.R. is of the year, 2011 but the petitioner has surrendered in the year, 2017 and also his application for anticipatory bail was rejected by this court vide order dated 30.06.2016 passed in Cr. Misc.
Patna High Court Cr.Misc. No.10564 of 2017 (2) dt.22-03-2017 2/2 No.15111 of 2016, as such, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer for bail after framing of the charge in this case, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
