JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kathaiya P.S. Case No. 124 of 2014, registered under Sections 304(B), 201/34 of the Indian Penal Code.

The accusation is of killing of Nitu Kumari, daughter of the informant by her husband and other in-laws due to nonfulfillment of demand of dowry. Learned counsel appearing on behalf of the petitioner submits that there was love affair in between the petitioner and Nitu Kumar and, accordingly, the marriage was also performed. Further submission is that Nitu Kumari died due to illness at the matrimonial house and information was also given to the informant Sushila Devi, mother of the deceased,

Patna High Court Cr.Misc. No.56865 of 2015 (5) dt.01-03-2016 2/2 who used to reside in Madhya Pradesh and due to that reason informant and her family members could not reach in time and dead body started decomposing, thereafter last rite ceremony of the deceased was performed by the villagers. Further submission is that the daughter of the petitioner is not missed as detailed in F.I.R. and she is residing with the mother of the petitioner at the house, which has come in paragraph Nos. 24 and 46 of the case diary.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Jha, Judicial Magistrate 1st Class, Muzaffarpur in connection with Kathaiya P.S. Case No. 124 of 2014.
