This is a petition for grant of regular bail for offence under Section 30(a) of the Bihar Excise Act. From a motorcycle 21 liters of country made liquor was recovered and two persons, including the petitioner, who were found riding on the said motorcycle, were apprehended.

The petitioner has stated on oath that he has got no criminal antecedent and is in custody since 23.11.2016. Considering the nature of allegation and the period already undergone, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 83 of 2017/12 of 2017 arising out of Roh P.S. Case No. 82 of 2016 to the satisfaction of the Additional District & Sessions Judge, II, Nawadah, or successor Court with

Patna High Court Cr.Misc. No.9062 of 2017 (3) dt.18-03-2017 2/2 the condition that the petitioner shall fully cooperate with the investigation/trial of the case and if the Court below would come to notice that the petitioner has committed similar type of offence in future, the Court below shall be at liberty to cancel the bail bond of the petitioner in this case also.
