The petitioners seek bail in connection with Daudpur P. S. Case No. 264 of 2019 dated 31.12.2019 instituted for offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

110 litres of country-made liquor is said to have been recovered from the motor-cycle which was being driven by the petitioners.

The defence of the petitioners is that they have

Patna High Court CR. MISC. No.11037 of 2020(2) dt.28-02-2020 2/2 falsely been implicated in this case and the recovery has been saddled upon them for feeding fat the old grudge. The petitioners are said to be in custody since 01.01.2020.

Petitioner no. 1 is reported to be without any criminal antecedents, whereas petitioner no. 2, though is an accused in a case of similar nature, but is on bail in that case.

Considering the afore-mentioned facts, the petitioners, above-named, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Saran at Chapra in connection with Daudpur P. S. Case No. 264 of 2019.
