JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 307/120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner and five others is of indiscriminate firing, causing injury to the informant at three places. One injury was caused at right hand ankle, second was at right hand arm and third was on the right side of the chest. Submission of the petitioner is that the petitioner had sustained injury in the same occurrence by acid burn causing damage to his eyes. The allegation is general and omnibus and the petitioner is in custody since 09.06.2016.

No.9791 of 2017 (3) dt.29-03-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Sitamarhi/Successor Court, in connection with Riga P.S. Case No.319 of 2015, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
