JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 The petitioner seeks regular bail in connection with Amas P.S. Case No. 218 of 2019, registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 1000 Kgs. of Mahua flower from the pick up van and petitioner is said to be the owner of the vehicle.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and in fact there is no recovery from the possession of the petitioner. Further, the petitioner is having no criminal antecedent and is in judicial custody since 25.11.2019 and also the charge-sheet has been submitted, therefore, there is no chance of tampering with the evidence.

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya in connection with Amas P.S. Case No. 218 of 2019.
