The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

The prosecution case is that on 28/29.11.2015 the minor sister of the informant namely, Mithu

Patna High Court Cr.Misc. No.4250 of 2016 (2) dt.30-01-2016 2/3 was found missing when it was found that the jewellery, ATM Card, cash and mobiles were also missing. It is alleged that the sister of the informant was abducted by son of the petitioner when the petitioner also participated.

It is submitted by learned counsel for the petitioner that the thrust of accusation is against the son of the petitioner and son of the petitioner is also traceless for which a complaint was before the S.P. Co-accused Md. Fakhruddin name was sprang up during investigation in 164 Cr.P.C. statement of Lamina Devi and Rita Devi to the effect that he brought the victim girl to their house, who has been granted anticipatory bail by the learned court below.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the thrust of accusation against the son of the petitioner, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dehri, Rohtas in connection with Dehri (T) P.S. Case
