Heard learned counsel for the petitioner and learned counsel for the respondents.

Petitioner has prayed for the following relief: "For issuance of an appropriate writ and/or direction upon the respondents-authorities to set up an inquiry by any independent agency with regard to the irregularities/misappropriation of

Patna High Court CWJC No.16965 of 2018(2) dt.06-01-2020 2/3 huge public money in large scale i.e. crore and crors is being done by the respondent-town panchayat Ram Nagar, West Champaran in collusion with concerned company who are involved in the aforesaid misappropriation of the said public huge money in purchasing the two wheeler dustbin GBRW 24-04 of 240 litres sintex company which has been purchased by the respondents-Town panchayat Ramnagar incollusion with company at the rate of 1800/- per Dustbin Instead of Rs.

7500/- per Dustbin besides Dustbin of 660 litres for which minimum demand of quotation published tender, similarly payments made of 1500 pieces of Dustbin by the town panchayat, Ram Nagar but only 1000/- Dustbin has been received from the company concerned out of which rupees of 500 Dustbin has been irregularities/misappropriation by the town panchayat Ramnagar in-collusion with the company concerned, similarly real price of Mayar Bier company 45 Vad L.I.G. Bulb about Rs. 500/- but the same has been purchased of Rs. 1500/- perhapes at Delhi similarly Real price of small trolly of small tractor about Rs. 5000/- but the same has been purchased of Rs. 1,80,000/- and real price of Thela of three wheelers about of Rs. 3500/- but the same has been repaired of Rs. 3500/- but the same has been repaired of Rs.3500/- per Thela."

After the matter was heard for some time, learned

Patna High Court CWJC No.16965 of 2018(2) dt.06-01-2020 3/3 counsel for the petitioner submits that petitioner shall be content if a direction is issued to the concerned respondents to consider and decide the representation, which the petitioner shall be making afresh within a period of four weeks from today. Learned counsel for the State states that upon receipt of such request, if any, the same shall be dealt with in accordance with law, expeditiously and positively within a period of three months from the date of receipt thereof. Equally, liberty is reserved to the petitioner to take recourse to such alternative remedies as are otherwise available in accordance with law.

We are hopeful that as and when petitioner takes recourse to such remedies, as are otherwise available in law, before the appropriate forum, the same shall be dealt with, in accordance with law and with reasonable dispatch.
