Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B) and 201/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Petitioner is in custody since 11.06.2019. There is allegation of demand of motorcycle by the petitioner and for non-fulfillment of the same, victim was tortured. Death took place in the house of the petitioner. Dead body was disposed of without information to the police or to the parents.

Considering the presumption of dowry death against

Patna High Court CR. MISC. No.17114 of 2020(4) dt.17-09-2020 2/2 the petitioner, I am not inclined to enlarge him on bail at this stage in connection with Sahebpur Kamal P.S. Case No. 148 of 2019 pending in the Court of learned Chief Judicial Magistrate, Begusarai.

Hence, prayer for bail is refused.

However, petitioner may renew prayer for bail after framing of the charges.
