2. The petitioner is in custody in connection with Goh P.S. Case No. 340 of 2023 registered for an offence punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that from perusal of the seizure list, it appears that the petitioner is named in the FIR but there is no recovery from the conscious possession of the petitioner and one country made pistol recovered from the possession of other co-accused Manoj Mistri. Petitioner has got clean antecedent and he is in custody since 08.11.2023.

4. Learned APP for the State opposes the prayer for regular bail of the petitioner.

5. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Aurangabad/concerned Court in connection with Goh P.S. Case no. 340 of 2023.
