JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the victim is languishing in jail since 19.03.2015 in a case registered for the offences punishable under Sections 498A and 302/34 of the Indian Penal Code.
The accusation is of killing the sister of the informant after 15 years of the marriage by throttling her. It is submitted by learned counsel for the petitioner that the victim died due to illness and proper information was given to the informant's family. Admittedly, the informant is not the eyewitness to the occurrence and there is no direct evidence collected against the petitioner during investigation. The impugned order also does not suggest any direct evidence collected against the petitioner. Moreover, investigation has already concluded.
Patna High Court Cr.Misc. No.857 of 2016 (2) dt.06-01-2016 Considering the fact that investigation has already concluded, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1st Class, Saran at Chapra in connection with Taraiya P.S. Case No. 49 of 2015.
