The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on a raid being conducted, about 47 litres of liquor was recovered from the house of one Vijay Rai. Two accused persons who made an attempt to escape were caught and disclosed their name as Akhilesh Kumar and the petitioner herein.

It is submitted by learned counsel for the petitioner that from the F.I.R. itself, it would transpire that no incriminating article has been recovered either from the

Patna High Court CR. MISC. No.20562 of 2021(2) dt.06-09-2021 2/2 petitioner's possession or his house. Co-accused Akhilesh Kumar has been enlarged on bail. The petitioner is in custody since 21.12.2020 and has no criminal antecedent. Investigation in the case has concluded.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Sadar P.S. Case no.719 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
