21-01-2016 Heard Sri Nachiketa Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody in Kanti P.S. Case No. 390 of 2015 registered for the offence under Section 25(1-B)A/26 of the Arms Act, 1959, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that on false accusation, the petitioner was arrested showing recovery of one loaded country-made pistol and two cartridges, whereas, the petitioner is having clean antecedent and he is in custody since 26-08-2015.
Learned Addl. Public Prosecutor has opposed the prayer for bail.
However, keeping in view the nature of accusation,
Patna High Court Cr.Misc. No.57677 of 2015 (2) dt.21-01-2016 2/2 period of custody as well as clean antecedent of the petitioner, let the petitioner namely Aklu Bhagat be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., (West) Muzaffarpur in Kanti P.S.
