The petitioner is apprehending his arrest in connection with Pakaridayal P.S.Case No.166 of 2018,G.R.No.6011 of 2018 registered for offences punishable under Section 379 of the Indian Penal Code.
Allegation against the petitioner is that he has stolen away motorcycle of the informant and that motorcycle has not been recovered.
Submission of the learned counsel for the petitioner is that as a matter of fact there is talk of sale between the petitioner and the informant with respect to sale of the motorcycle of the informant at the cost of Rs.15,000/- and paid Rs.10,000/- as advance and thereafter with a view to digest the money, the present case has been lodged.
Patna High Court CR. MISC. No.10834 of 2019(3) dt.26-04-2019 2/2 Heard learned A.P.P. , who has opposed the pryaer for bail on the ground that he is named in the FIR and that has been supported by the other witnesses also and it appeas from from the impugned order. .
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Couron its own merit.
With the aforesaid direction, this application is dismissed.
