JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioner seeks bail in connection with Kotwali P.S. Case No. 435 of 2019, registered for the offences punishable under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation is of recovery of one pistol from the possession of the petitioner and apart from that he is accused in six other cases.
Submission of learned counsel for the petitioner is that whole story is planted by police and he is in custody since 17.9.2019.
Heard learned APP also.
In view of allegation and criminal antecedent, I am not inclined to grant bail to the petitioner at this stage. However,
Patna High Court CR. MISC. No.8770 of 2020(2) dt.28-02-2020 2/2 once charge has been framed in this case or he has remained in custody for seven months, petitioner is at liberty to renew his prayer for bail.
This application is, accordingly, dismissed.
