JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-04-2023 Heard learned counsel for the petitioner, learned counsel for the vigilance and learned APP for the State. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 120B and 34 of the Indian Penal Code. The allegation against the petitioner is that she has been appointed as a Panchayat Siksha Mitra teacher on the basis of forged document for the purpose of cheating due to which this case has been lodged against her.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. It is further

Patna High Court CR. MISC. No.10520 of 2023(2) dt.18-04-2023 2/2 submitted that petitioner has already been terminated to her service from the post of Panchayat teacher. She has got no criminal antecedent moreover, she is languishing in judicial custody since 06.12.2022.

Learned APP appearing for the state as well as learned counsel for the vigilance have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Rudrapur P.S. Case No. 53 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Jhanjharpur, District Madhubani.
