====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-04-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application for grant of anticipatory bail arises out of Raj Nagar P.S. Case No. 202 of 2024, disclosing offences under Sections 272, 273 and 34 of the I.P.C. and 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the police got secret information that on two motorcycles, the liquor was being transported, intercepted the bike, however, the riders, upon seeing police vehicle, started running away and succeeded after leaving the motorcycle on the spot. On search, the police recovered total 135 litres of Nepali liquor from both the bikes while 45 litres of Nepali liquor has been recovered from the

4. Learned Counsel for the petitioner submits that petitioner has been made accused on the basis of the fact that he happens to be the registered owner of the bike in question. He further submits that at the place of occurrence nobody has identified the petitioner, however, the bike in question was borrowed by his friend for some urgent work and the petitioner was not aware about the fact that he was carrying illicit liquor on the same.

5. On the other hand, learned counsel for the State argued that petitioner is the registered owner of the vehicle from where 45 litres of Nepali liquor has been recovered.

6. Regards being had to submissions made by the parties and taking into consideration the justification given by the petitioner that his bike was borrowed by his friend for some urgent work, I am inclined to grant the privilege of anticipatory bail to the petitioner.

7. This application is, accordingly, allowed.

8. Let the petitioner above named petitioner, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount
