JUSTICE JYOTI SARAN ORAL ORDER 27-01-2016 Heard Mr. S.B.K. Mangalam, learned counsel for the petitioner, Mr. Neeraj Rai, learned A.C. to S.C.19 for the State and Mr. Sanjay Kumar for the Bank.

The limited grievance of the petitioner is that on account of some allegations against the erstwhile Chairman of the Mohammandpur Panchayat, Primary Agriculture Credit Cooperative Society, Block-Vaishali in the District of Vaishali

Patna High Court CWJC No.1631 of 2016 (2) dt.27-01-2016 2/3 that the cash credit limit to the petitioner society was stopped and has not been resumed.

It is the argument of Mr. Mangalam that whatsoever be the charges against the previous Chairman regarding the outstanding pending against him, the same amount has been since returned. He submits that the cash credit limit is necessary for the functioning of the Society and would be only given by the Bank concerned on a recommendation made by the District Cooperative Officer in this regard. It is further the argument of learned counsel that although such a request has been made by the petitioner on 29.12.2015 before the District Cooperative Officer, Hajipur, Vaishali but has remained pending.

Having heard learned counsel for the parties and considering the nature of grievance raised herein, the writ petition is disposed of with the direction to the District Cooperative Officer, Vaishali to consider the request made by the petitioner, a copy of which is placed at Annexure-5/1 of the writ petition and dispose of the same in accordance with law and after giving an opportunity of hearing to the petitioner expeditiously and preferably within four weeks from the date of receipt/ production of a copy of this order.
