Mr.Md. Matloob Rab ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Barahiya P.S. Case No. 273 of 2018, registered under Sections 307 and 387/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation against the petitioner is to shot fire causing injury at the neck of the informant.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier refused vide order dated 19.07.2019 passed in Criminal Misc. No. 35681 of 2019 with direction to the trial court to expedite the trial and make efforts to conclude the trial as early as possible preferably

No.10007 of 2020(2) dt.29-02-2020 2/2 within a period of six months from the date of receipt of order and if the trial of the petitioner is not concluded with the aforesaid period of six months, the petitioner will be at liberty to renew his prayer for bail after six months and now more than six months has already been lapsed but the trial of the petitioner has not been concluded as yet.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Barahiya P.S. Case No. 273 of 2018. Out of two sureties, one surety must be the close relative of the petitioner and further the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
