The petitioner seeks bail in connection with Pipra P.S. Case No. 261 of 2018 instituted for the offence under Section(s) 401/413/414 of the Indian Penal Code.

Learned counsel for petitioner has submitted that the name of this petitioner has been taken in the written report by two persons, namely, Santosh Das and Hari Sahani from whose house police has recovered motorcycle which is alleged to be stolen one. It is alleged that during investigation one motorcycle has been recovered from possession of this petitioner. Learned counsel further points out that seizure list was prepared with respect to recovery made from possession of this petitioner which is part of the FIR, wherein, it is mentioned that recovery

Patna High Court Cr.Misc. No.9374 of 2019(2) dt.18-02-2019 2/2 has been made from Mishraeen Tola Chowk.

Learned counsel for petitioner has submitted that police has taken the signature of petitioner on seizure list and falsely implicated in this case.

Petitioner is in custody since 04.10.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S.
