The Petitioners seek bail in Pandaul P.S. Case No. 212 of 2016 instituted for the offence under Section(s) 147, 148, 149, 323, 324, 307, 354, 427, 504, 506 of the Indian Penal Code, subsequently Section 302 I.P.C was also added. It has been submitted that petitioners have voluntarily surrendered on 12.01.2017. There is no specific allegation of overt act against these petitioners. As per written report co-accused Chandra Bhushan Jha gave Kulhari blow on the head of the Upendra Jha causing serious injuries to him. It is further alleged that other
Patna High Court Cr.Misc. No.14599 of 2017 (2) dt.20-04-2017 2/2 accused persons also assaulted him with lathi and danda. As such, there is no allegation of specific overt act against these petitioners. Learned counsel for the informant has appeared and opposed the prayer for bail of the petitioners. In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the Petitioners, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S. Case No. 212 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioners.
