ANJANA MISHRA ORAL ORDER 17-02-2016 Heard learned counsel for the petitioners and the learned counsel for the informant as well as the learned counsel appearing on behalf of the State.
The petitioners are apprehending their arrest in connection with Gurua P.S. Case No.101 of 2015 for allegedly having committed the offences under Sections 147, 149, 341, 323, 325, 354, 448, 337, 307, 427, 153A and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that there is case and counter case between the parties and the petitioner
Patna High Court Cr.Misc. No.3638 of 2016 (2) dt.17-02-2016 2/2 and the informant are next door neighbours. It is further submitted that the injuries purported to have been inflicted on the person of the informant have been found to be simple in nature as though she was referred to the A.N.M.C.H., Gaya, the informant lady did not stay long enough for being examined radiologically. A certificate to that effect has been annexed by the petitioner.
Considering the entire facts and circumstances of the case and that these petitioners have no criminal antecedents, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri G.N. Pandey, learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Gurua P.S. Case No.101 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
