The petitioner seeks bail in connection with Muffasil P.S. Case No. 406 of 2024 instituted for the offence under Sections 126(2), 115(2), 109(1), 118(1), 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

As per the prosecution case on 28-11-2024, informant and her family members were attacked by petitioner and others with iron rods, bricks, and weapons for not

Patna High Court CR. MISC. No.9750 of 2025(2) dt.24-02-2025 2/3 withdrawing a case. During the assault, several family members were injured and valuables, including a wristwatch and a gold chain, were snatched.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 30-11-2024. Petitioner bears two criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is case and counter case between the parties. It is alleged that petitioner has assaulted the informant, but from perusal of the injury report of the informant, it would reveal that injury is simple in nature. Parties are next door neighbours. Charge-sheet has been submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, nature of accusation and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with
