Petitioner is named in the first information report but according to prosecution case itself, the alleged occurrence took place on 20-08-2015 whereas; the first information report was lodged on 22-08-2015. Moreover, after institution of the present case, the informant filed a petition before the Additional Chief Judicial Magistrate, Araria, mentioning this fact that he gave the name of the petitioner on the basis of suspicion. No doubt, petitioner carries criminal antecedent of two cases but taking note of the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like
