JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-01-2021 Learned counsel for the petitioners seeks permission to withdraw the present bail application in respect of petitioner No. 5 (Suraj Thakur) as the petitioner No. 5 has already been arrested during the pendency of this case.
Permission is accorded.
The bail application in respect of petitioner No. 5 has become infructuous. It is, accordingly, dismissed as withdrawn. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with Khagaria P.S. Case No. 749/2019 registered for the offences punishable under Sections 147/149/323/341/354/307/ 379/427/448/504/506 of the Indian Penal Code.

No.11016 of 2020(3) dt.19-01-2021 2/2 As per the prosecution case, all the accused persons entered into the house of the informant, misbehaved with the mother of the informant and tried to outrage her modesty. It is further alleged that petitioners armed with iron, farsa, bricks and stones attacked his uncle Raju Sah resulting in head injury. It is submitted on behalf of the petitioners that there is long pending land dispute between the parties and the injuries are found to be simple in nature. It is further submitted that there is case and counter case between them and both the sides have sustained injuries.
Considering the aforementioned facts and circumstances, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Khagaria P.S. Case No. 749/2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
