Petitioner, who is in custody, seeks bail in connection with Jurawanpur P.S. Case No. 98 of 2018 registered for the offence punishable under Sections 304(B), 201, 120(b) of the Indian Penal Code.
Informant is the grandfather of deceased, who in his written complaint has stated that his grand-daughter was married to son of petitioner about 2 years before but she was being tortured for non-fulfillment of demand of Rs. 50,000/- and on 07.11.2018 he came to know that his grand-daughter has been killed by pressing the neck by petitioner and other family members and disappeared her dead body.
It has been submitted on behalf of the petitioner that
Patna High Court CR. MISC. No.9595 of 2019(3) dt.28-03-2019 2/3 petitioner is the mother in law of deceased and residing separately from her husband and she has no concern with the deceased. Petitioner has died due to loose motion and vomiting. Petitioner has no criminal antecedent and she is in custody since 08.11.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Vaishali at Hajipur, in connection with Jurawanpur P.S. Case No. 98 of 2018 subject to the conditions that:-
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.
(3) If the petitioner tampers with the evidence
Patna High Court CR. MISC. No.9595 of 2019(3) dt.28-03-2019 3/3 or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
